Land Use Seminar

Professor Sullivan - Course Description

This seminar includes a simulation exercise revolving around a series of land use problems which might confront lawyers, planners, local officials and others. The problems involve Oregon land use law, regional planning issues, federal/state relations and local government land use regulation. Each seminar participant is assigned a role to play considering his or her particular interests, background or experience. There is a fairly minor paper requirement and arrangements may be made to use this seminar to fulfill the law school’s writing requirement. There are no prerequisites—however, course work in administrative law, environmental law, land use, or municipal governments is recommended.

The American Bar Association accreditation standards require students to regularly attend the courses in which they are registered. Lewis & Clark expects students to attend classes regularly and to prepare for classes conscientiously. Specific attendance requirements may vary from course to course. Any attendance guidelines for a given class must be provided to students in a syllabus or other written document at the start of the semester. Sanctions (e.g., required withdrawal from the course, grade adjustment, and/or a failing grade) will be imposed for poor attendance.

Professor Litwak - Course Description

This seminar teaches the practice of land use law using a simulation with exercises revolving around a series of land use problems that might confront lawyers, planners, local officials and others. The problems will involve Oregon land use law, regional planning issues,

federal/state relations or local government land use regulation, or a combination of these. There are no prerequisites, however, course work in administrative law, environmental law, land use, or municipal governments is recommended.

Students are expected to participate in all class discussions and simulation exercises. The simulations involve writing assignments. There is no textbook for this seminar; reading materials will include local government ordinances, LUBA rules, state and federal statutes and cases.

Students will be expected to find the reading materials, most of which are available on the internet. Grading will be based on the writing assignments and participation in the simulations and class discussion.
